A court in Ras Al Khaimah has mandated a man to repay his brother Dh128,333.33, plus 9% annual interest, following a breach of trust in an inheritance case. The judgment requires the defendant to cover all legal expenses and attorney fees.
## Background of the Dispute
The conflict arose over agricultural land in Wadi Haqeel, inherited from the brothers' late father. In 2014, the plaintiff authorized his brother to manage and sell his share of the property. The defendant sold the land in February 2025 for Dh820,000 but failed to transfer the plaintiff's share, leading to legal action.
## Legal Proceedings
The plaintiff's lawyer, Hanan Salem Al Shimili, successfully argued that the defendant unlawfully withheld the funds despite having a valid power of attorney. The defendant's admissions during police and prosecution investigations were pivotal in the court's decision.
## Criminal Conviction Impact
The defendant had previously been fined Dh10,000 in a related criminal case for breach of trust. This conviction bolstered the civil case, as the court used these admissions as evidence, expediting the judgment.

The court found no legal justification for the defendant's actions, citing UAE Civil Transactions Law. Although the plaintiff sought 12% interest, the court awarded 9%, consistent with local judicial practices. The interest is calculated from the lawsuit's filing date until full payment is made.
