## Legal Deductions from Gratuity
In the UAE, end-of-service gratuity is a significant financial benefit for employees. However, under certain conditions outlined in the UAE Labour Law, employers can legally deduct amounts from this gratuity. These deductions may occur if there are overpayments or unpaid loans, unpaid contributions for pensions or insurance, penalties for disciplinary violations, court-ordered debts, or damages caused by the employee's negligence.
## Bank Involvement in Gratuity
Banks in the UAE can also claim gratuity to recover unpaid debts, such as loans or credit card balances. This is often stipulated in loan agreements, allowing banks to use gratuity if an employee defaults or leaves their job with outstanding debts. Employees are advised to inform their banks of any job changes and consider using separate accounts for gratuity deposits.
## Eligibility and Calculation
To be eligible for gratuity, employees must have completed at least one year of continuous service with the same employer. The calculation is based on the basic salary and years of service: 21 days of basic salary per year for the first five years, and 30 days for each subsequent year, with a maximum limit of two years' basic salary.
