Sharjah court lifts arrest warrant in Dh2m debt case

## Court Decision

A Sharjah court has lifted an arrest warrant against a Gulf national involved in a debt case exceeding Dh2 million. This decision came after the debtor successfully demonstrated that his insolvency application had been accepted by Dubai Courts.

## Background

The case originated in October 2025 when the Sharjah Court of First Instance ordered the debtor to pay Dh2 million plus 5% annual interest to a creditor. The debtor was notified in December 2025 and given a week to settle the amount. Failure to pay led to the issuance of an arrest warrant.

## Legal Proceedings

In March 2026, the debtor requested the Sharjah court to suspend the arrest warrant while his insolvency case was under review in Dubai. Initially, the court demanded proof of the insolvency application’s acceptance, which was later provided, resulting in the cancellation of the arrest warrant.

## Insolvency Protection

Dr. Alaa Nasr, the debtor's lawyer, explained that insolvency proceedings allow debtors to present their financial situation to the court, which can then assess and decide on the appropriate legal actions. Acceptance of insolvency applications provides debtors with legal protection, suspending enforcement actions and halting interest accruals during the case review.

## Implications

This legal protection enables debtors to seek the lifting of arrest orders related to enforcement proceedings, subject to court approval. The process ensures that all financial claims are managed under court supervision, safeguarding the debtor's assets until a final judgment is made.
