Scientists beat Johnson & Johnson in fight over talc cancer research

## Court Ruling

A US judge in Virginia has ruled in favor of three researchers accused by Johnson & Johnson of defamation. The company claimed that a 2020 study by doctors Theresa Emory, John Maddox, and Richard Kradin falsely linked its talcum powder products to mesothelioma, a rare cancer. However, the court found no evidence of malice in the publication.

## Study Details

The contested study analyzed 75 mesothelioma patients who had no known asbestos exposure other than through cosmetic talc products. Although some data errors were identified, the judge concluded these were not intentional or obvious at the time of the study.

## Johnson & Johnson's Response

Johnson & Johnson plans to appeal the ruling, seeking a trial to address its claims of false statements regarding talc and asbestos exposure. The company has been embroiled in extensive litigation over its talc products, having settled related cases for at least $5.5 billion.

## Data Concerns

The case also highlighted issues with patient data, as Johnson & Johnson noted that eight patients from the 2020 study were also part of a 2019 study by another researcher. The researchers explained that anonymized data sets and information from lawyers sometimes made it difficult to identify duplicate patients.

## Ongoing Legal Battles

This ruling is a setback for Johnson & Johnson's defamation claims, but the company's broader legal challenges concerning its talc products continue.
