The woman, holding a 51% stake, alleges that her partner, who manages the company, did not provide her with company records or her due profits.

## Legal Proceedings

Initially, the businesswoman sought the appointment of a corporate expert to review the financial accounts and determine her entitlements. Her partner countered, requesting an expert to verify her capital contributions and assess alleged losses. The court combined both claims and appointed an accounting expert, whose report was later dismissed by the lower court.

## Supreme Court Decision

The Supreme Court found that the lower court failed to address the businesswoman's request for a new expert, which was a significant oversight. Citing Article 121 of Federal Decree-Law No. 35 of 2022, the Supreme Court emphasized the need for courts to address substantive requests that could influence case outcomes. Consequently, the Supreme Court annulled the previous judgment and sent the case back to the Court of Appeal for further consideration.
