## Key Exceptions to Notice Requirement
In the UAE, employees typically need to provide a notice period before resigning. However, Article 45 of the UAE Labour Law outlines specific situations where immediate resignation is permissible without notice.
### Employer Violations
If an employer breaches the employee's rights under the Labour Law, its regulations, or the employment contract, the employee can resign without notice. Conditions include notifying the Ministry of Human Resources and Emiratisation (MOHRE) at least 14 days prior, allowing the employer a chance to rectify the issue, and ensuring the employer fails to do so.
### Workplace Assault
Employees can resign without notice if assaulted by their employer or a representative. The incident must be reported to the authorities and MOHRE within five working days.
### Unsafe Work Conditions
If the workplace poses serious health or safety risks and the employer does not address these issues, employees can leave immediately.
### Unapproved Job Changes
If an employee is forced to perform tasks significantly different from those agreed upon in their contract without consent, they can resign without notice.
## Standard Notice Period
Outside these exceptions, Article 43 requires a notice period of 30 to 90 days for contract termination. The contract remains valid during this period, and the employee is entitled to their full salary. If notice is not served, compensation is required.
## Reducing the Notice Period
The notice period can be reduced or waived if both parties agree, provided it does not infringe on rights. It is crucial to review the employment contract and ensure compliance with legal requirements before resigning without notice.
